Disable fake "No subtitle" subtitle?

When I create an MKV with a subtitle, it adds a separate "No subtitle" (when I could instead just turn subtitles off in the player).

How to disable this behaviour?

Please explain better. If there is no subtitle present on the DVD or BD, there should be no subtitle present in the MKV file.

HOWEVER, many disks that have subtitles will have multiple tracks... One (or more) of which will just be signs, or subtitles for music that was not dubbed over. These are often called "forced subtitles". There will be a LOT less content in them.
