Failed to Open Disc - Message

I have a T2 terminator 2 HDDVD German disc which I would like to rip.
MakeMKV recognises the disc, Windows Explorer recognises the disc and all the folders appear.
I have a Toshiba GGW-H20L internal PC drive. I have tried another HDDVD's and it worked fine .
I have noticed that the T2 disc compared to the other disc I tried has AACS v3 protection - could this be the reason I get the Failed to open disc error ?
Does MakeMKV rip disc with this protection ?
