I don't know enough about the bug to know whether the files would be fixable, but it might be worth checking your M2TS files with:
ffmpeg -i testfile.m2ts -f null -

to see if they're okay. It might be that only DV streams are affected, or something like that.

I use tsmuxer (latest) for DV mkv ...

I can use the subtitles in .m2ts (from .srt).
I have problems with the subtitles in .ts created with tsmuxer.

I use Kodi 19.3 from this site.
Its an altered version of Kodi that installs next to the Google Play Store version so you can easily test it
