For DVDs the issue is messier than BDs in that DVDs utilize two different ways to deal with forced subtitles - they can either be in their own track, or suitably tagged and embedded in a fixed language subtitle track. There are definitely players out there that, with No Subtitles selected during playback, will show only the forced subtitles in a VIDEO_TS structure. The default.mmcp.xml is stored inside the appdata.tar that's stored to the MakeMKV program directory, at least on Windows.

I'm encoding them to H.265, burning in the forced at that time, but leaving the non-forced as user selectable. Which could be done just as easily with one forced track and one regular track, both not burned in. Even if you insist on MP4 as a container, most players would play the external subs just...

Probably because it's pointless. Why have the regular subs without the forced items anyway? Because the forced items will then overlay your burned in forced items? Burning in means re-encoding which is a no-no anyway. And since most current players read the flags, having only the forced items as the...

Strangely VLC and mkvtoolnix are also only seeing one English subtitle track? You could paste the output from a MediaInfo scan of the largest m2ts (set to view > text, then put it into code tags).
